A US appeals court has raised doubts about the Justice Department’s attempt to force California to set aside mail-in ballots that the federal government says were likely sent to noncitizens.
Circuit Judge Mark Bennett said on Sunday that the three-judge panel would issue a decision as quickly as possible after holding an unusual weekend hearing in the case.
Bennett, who was appointed by President Donald Trump, questioned whether the federal government’s request could be reconciled with the US Constitution, which gives states broad authority to administer elections.
